DECISLON -

C.T.A. Case No. 4648

Mds. Inventory, Beginning,

per Protit & Loss Statement

atchd. to 1986 income tax

return of Petitioners

(Annex C) P186, 744. 60

Mds. Inventary, Ending,

Dec, 31,1985 per Statement

of Net Werth, atchd. ta Tax

Amnesty Return, under EQ 41

(Annex D-2) Pi56, 744. 60

Variance P 30, 000. 00

This discrepancy, which had the effect of

overstating the cost ot sales and consequently

understating the gross profit of the 1986

income of the Petitioners, was obviously a

cause of oversight on the part of the

Petitioner’s book-keeper, and that there was no

deliberate intention of the Petitioners to

defraud the revenues.

Although the Petitioners da nat dispute

the merit of the discrepancy of P30,000. 00, the

Petitianer availed of the tax amnesty law under

the provisions af EQU41, and Petitioners naw

wish toa inveke their immunity and privilege for

the BIR nat ta use as evidence their

(Petitioners) declaration in EQ 41 af an item

in the Statement of the Net Warth under EQ 41

computing a deficiency tax. x x x" {Italics

supplied).

From the foregoing avermentse, the petitioners

themselves had admitted the fact that there is a

discrepancy in their balance at merchandise inventory in

the years 1985S and 1986 which had an ettect or

understating their gross prafit in 1986 in the tatal sum

of Pad, 000. ad. Consequently, the petitioners had

likewise, in effect, admitted that it was nat able to pay

the carrect and full amount at the incame tax ta which

they are liable.

DECISION -

C.T.A. Gase No. 4648 While it may he true that real properties are conpidered as assets, the petitioners must bear in mind that these properties or assets are important variables in the ' computation of networth. The formula for computing networth is Assets less Liabilities. Mathematically theretore, with liabilities heing canstant, an increase in assets is accampanied by an increase in networth.

Thus, taking into accaunt the petitioners’ undervalued assets in their statement af netwarth, it can easily he wen ‘hiew the discovery of the additional and undeclared assets cansisting of real preperty holdings ameunting to P49,510.,00 resulted iainto an increase in their .netwaorth after they availed oat the tax amnesty under EQ 41, And according ta the said law, such increase is considered as taxable income.

In tact, by virtue af the admissions made by the petitianers in their iesditie, they had alse in effect admitted that they paid an amnesty tax less than what they should have actually paid.

Anent the petitioners’ diability account of: P175,000.00 which was treated by the respondent as incame, We find that the petitianers have fully substantiated that the amount «of P150,000.00 ais indeed, a liability and not income, This canstitutes the 579

PECISTON -

G.T.A. Uase No. 4648 outstanding balance af the loan they obtained fram the Philippine Cammercial and Industrial Bank as evidenced hy a Heal Estate Mortqage | dated February 15, 1984 (Exhibit "F") and a certitication dated January 18,1991 issued hy the said - hank (see p. 144 of BIR records), Uther than the manifestatian of their counsel, na - evidence, documentary or testimonial, was ever presented — the petitioners to establish that the remaining balance of P25, 000,00 truly represents their liabilities bo vied cits suppliers.

Finally, with regard to the last issue, we hald thet the respondent had failed ta substantiate his claim that the petiticaners had fraudulently attempted ta evade their tax liabilities. Fraud is never presumed. Courts never sustain findings af fraud pou circumstances which create only suspicions and even the understatement of a tax ‘8 not by itself proof af fraud tor purposes of tax evasion (Cammigsioner oat Internal Revenue vs. Javier dJr., i9g SCRA &24),. We are therefare inclined ta adopt the admission and explanation af the petitioners that their liability for deficiency incame taxes arose fram mere aversight and inadvertence, Preseli nding from the foregoing discussicn, we find the petitioners liable for income tax deficiencies amounting ta P27,070.06, camputed as foallcaws:
