quote: ane C how, oe tale VUR The lone question tendered resolutian is whether or nat Obligation ta withheld and pay income at-source on the rayalties ais upan acerual of the royalties oar upon actual remittance or payment thereof.
Fetitioner maintains that there no Obligation to deduct, withhold, and the withholding tax ain i972 since royalties cauld mot be remitted due Central Bank restrictians. In submitting, however, that the liability to withhold and pay the income tax withheld at source from royalty payments to a non-resident foreign corparatian, like Rayer Sktiengesellachaft, Leverkusen Hayermerk, is at the time of the accrual of royalties and not at the time of actual remittance or payment thereof, respondent relies mainly on Bureau clated Internal Revenue Ruling Wo. Yieoos, February 26, 1971, the pertinent portians of which are quoted as followss "This refers to your letter dated February 14, 1971 requesting ai ruling as to the basis af the withhalding tax due on film rentals or royalties Payable by you to non-resident foreign film corporations.
n x M oy "In your letter, you cantended that the ea) withholding tax shoauld he based only an actually remittable amount woder Central Bank regulations and not an the entire amount due and payable to the non-resident foreiaqn corporation.
