CTA CASE Us, asco Petitioner disputes the finding ‘end eonelusion of the Golleetor of Customs and contends thet said cigoretées and whiskey were necessary provisions of the vesse) and an amendment of the Stere List so as to inelude the same shoula have been allowed. We are fully in agreement with the finding an@ eonelusion of the Colleeter ef Cus- toms ih The evidence of record shows thet while in the United Stater, the Mester and Purser of the vessel par- chased «tthout authority 6,750 cartons of assorted cigarettes worth 07,090.00 and 1,464 bottles of assorted whiskey worth $2,910.00, while the normal consumption of cigarettes end whiskey of seid ver sel for one trip Was 1,124 cartons of cigorettes and 464 bottles of whis- key. Alse, it was shown that the arrival of said ves- sel on June 25, 1961 in Mantle was its lest trip prior to its being turned over to the Liberation Steamship Company. It is obvious that . portion of the cigarettes and whiskey purchased in the United States by the Master and Purser of the veseel without authority ef petitioner was intended tc be imported into the Philippines 4llegal- Ay, and ote, therefore, subject to forfeiture not only as The quantity of cigarettes and whis supposedly Aecasaary for provisions of the vessel for one trip, although not questioned by the Collector of Ccus- toms, appears to us excessive. :
