No. 130. -3- From this final assessment, petitioner ap- pealed to this Court, alleging, in her petition for review, that respondent's right to collect the tax in question by summary method has already pres- cribed in accordance with Section 51(d) of the Na- tional Internal Revenue Code; and that the assess- ment is without basis in law and in fact as it was solely based on the amount of #180,000.00 which is not imcome earned by her.
Neither petitioner nor her counsel appeared during the scheduled hearing on August 27, 1962. Whereupon, on motion of counsel for respondent, the Court ordered her to proceed with the presen- tation of her evidence. Respondent's counsel pre- sented only documentary evidence, after which the case was submitted for decision. The evidence of petitioner had established sufficiently and ade- quately the facts as heretofore stated.
On the basis of the pleadings and the facts established during the hearing, the issues are:
1. Whether or not petitioner is liable for deficiency income taxes in the total @ount of #55,577.25, inclusive of surcharges, interest, and compromise penalties for fail- ure to tlle returns and for late payment of the tax.
2. Whether or not the collection of the taxes have prescribed.
Petitioner failed to appear and present evid- ence or proof in support of her allegations in her 366
