REQUESTING THE METROPOLITAN WATERWORKS AND SEWERAGE SYSTEM (MWSS) TO AUTHORIZE THE LOCAL GOVERNMENTS OF METRO MANILA TO FIX AND UNDERTAKE RESTORATION WORKS ON LEAKAGE PIPES, DIGGINGS, AND EXCAVATIONS OF THE MWSS ALONG MUNICIPAL/CITY ROADS AND TO CHARGE THE COST THEREOF FROM CHARGES FOR WATER SERVICE BY THE MWSS TO LGUs
WHEREAS, it is the policy of the State to treat Metropolitan Manila as a special development and administrative region;
WHEREAS, to achieve this objective, paragraph (d), Section 3 of Republic Act 7924 provides the scope of Metropolitan Manila Development Authority (MMDA) services which include, among others, flood control and sewerage management . . . the formulation and implementation of policies, standards, programs and projects for sewerage system;
WHEREAS, the Metro Manila Council, in its meeting of February 13, 1997, has expressed concern over the numerous water leaks, diggings and excavations undertaken by the MWSS which are left haphazardly filled up, leaving unsightly ruts, potholes and lumps in municipal/city roads;
WHEREAS, to minimize, if not totally eradicate this blight which is causing the cities/municipalities of Metro Manila untold losses in terms of deterioration of roads and in order to protect and ensure public safety and interest, the Metro Manila Council (Council) in session duly assembled agreed to enjoin the MWSS to authorize the Metro LGUs to fix and undertake restoration works on water leaks, diggings and excavations of the MWSS along municipal/city roads. NOW THEREFORE, pursuant to Section 6 of RA 7924; be it resolved that the Council hereby enjoins the MWSS to authorize the LGUs in Metro Manila to fix and undertake restoration works on water leaks, diggings and excavations of the MWSS along municipal/city roads and to charge the cost thereof from charges for water service by the MWSS to LGUs.
