GPPB Resolution No. 12-2025 dated 25 November 2025 Page 1 of 3 RESOLUTION NO. 12-2025
APPROVING THE PROCUREMENT MODE SELECTION DECISION TREE UNDER SECTION 6 OF REPUBLIC ACT NO. 12009
WHEREAS, Republic Act (RA) No. 12009, or the “New Government Procurement Act,” took effect on 13 August 2024, while its Implementing Rules and Regulations (IRR) took effect on 25 February 2025;
WHEREAS, Section 91 of RA No. 12009 mandates that the Government Procurement Policy Board (GPPB) shall be the central body that sets strategic direction and makes policy decisions regarding all matters affecting public procurement, having due regard to the country’s regional and international obligations, and is tasked to lead the nation’s efforts in advancing public procurement reforms in accordance with the Act;
WHEREAS, Section 91.1 (c) of the IRR of RA No. 12009 further authorizes the GPPB to formulate and amend, whenever necessary, the IRR of the Act, associated issuances, and government procurement manuals, Philippine Bidding Documents and standard forms for procurement, and issue policy papers to ensure that the procurement process is streamlined and responsive to the needs of the government;
WHEREAS, Section 3 of the IRR of RA No. 12009 provides the Governing Principles on Government Procurement, which includes Section 3 (d) on proportionality by ensuring that the conditions and parameters in the development of requirements, choice of procurement mode, and implementation of contracts shall be reasonably proportional to the needs and circumstances of the Procuring Entity (PE), and the nature, scale and complexity of the project to be procured to ensure fair competition;
WHEREAS, Section 3 of the IRR of RA No. 12009 likewise includes Section 3 (e) on accountability where public officials and personnel take responsibility for their actions, decisions, and performance in the use of public resources and adhere to ethical standards. When warranted by circumstances, public officials and personnel directly or indirectly involved in the procurement process and in the implementation of contracts are investigated and held accountable for their actions, in accordance with applicable laws, rules and regulations;
WHEREAS, Section 26 of RA No. 12009 provides that the PE shall adopt any of the following modes of procurement consistent with the Fit-for-Purpose procurement approach:
(a) Competitive Bidding; (b) Limited Source Bidding; (c) Competitive Dialogue; (d) Unsolicited Offer with Bid Matching; (e) Direct Contracting; (f) Direct Acquisition; (g) Repeat Order; (h) Small Value Procurement; (i) Negotiated Procurement; (j) Direct Sales; and (k) Direct Procurement for Science, Technology and Innovation;
WHEREAS, Section 5 (m) of the IRR of RA No. 12009 defines Fit-for-Purpose as an approach to procurement that applies the most suitable mechanism or strategy designed to address the specific needs of the PE and each project, while promoting flexibility and responsiveness to different conditions and scenarios, based on factors or situations, such as, but not limited to, the nature and complexity of the project, market condition and readiness, urgency or risks, in order to ensure and achieve value for money;
WHEREAS, under Section 6 of RA No. 12009, the GPPB is mandated to develop, among others, a decision-tree to be included in the IRR, that shall guide PEs on which mode of procurement is the most fit for their desired purpose;
GPPB Resolution No. 12-2025 dated 25 November 2025 Page 2 of 3
WHEREAS, the Board resolved through GPPB Resolution No. 02-20251 to defer the issuance of the decision tree (“Procurement Mode Selection Decision Tree”) to allow further technical study and consultation;
WHEREAS, after review and discussion of the GPPB-Technical Support Office (TSO) and the GPPB Inter-Agency Technical Working Group, the draft Procurement Mode Selection Decision Tree and a mock demonstration of its digital interactive version were presented to the GPPB for consideration;
WHEREAS, after thorough deliberation and inputs from the members of the Board, the GPPB agreed to approve the Procurement Mode Selection Decision Tree, and to further direct the GPPB-TSO to complete the development of the digital interactive version thereof to facilitate stakeholder usage;
NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law and other executive issuances, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the following:
1. APPROVE the Procurement Mode Selection Decision Tree and ADOPT the same as an Annex of the IRR of RA No. 12009. A copy of which is attached as Annex “A”;
2. DIRECT the GPPB-TSO to develop and issue an accompanying User Guide to the Procurement Mode Selection Decision Tree;
3. AUTHORIZE the GPPB-TSO to develop the digital interactive version of the Procurement Mode Selection Decision Tree to be completed within twenty-five (25) working days from issuance of this Resolution;
4. DIRECT the GPPB-TSO to conduct periodic study and continuing updating of the Procurement Mode Selection Decision Tree as may be necessary, consistent with RA No. 12009, its IRR, and other applicable rules and regulations; and
5. DIRECT the GPPB-TSO to undertake appropriate cascading and dissemination of the Procurement Mode Selection Decision Tree, with a reminder to the PEs that the tool serves only as a guide in identifying possible modes of procurement pursuant to
Section 6 of RA No. 12009 and Section 6.3 of its IRR, and that the results thereof do not constitute a definitive determination of the procurement mode/s to be utilized. The PEs are strictly enjoined to validate the identified conditions and recommended modes, consistent with the principles of accountability and proportionality, and the Fit-for-Purpose approach.
APPROVED this 25th day of November 2025 at Quezon City, Philippines.
1 Dated 04 February 2025, entitled “Approving the Implementing Rules and Regulations of Republic Act No. 12009, otherwise known as the New Government Procurement Act.”
