A trial is defined as the judicial examination and determination of the issues between the parties to a case. It is the process where the legal controversies between or among the parties are investigated and determined. During the trial, the parties present their respective evidence, which forms the bases for the court's judgment. While the term "hearing" can encompass various stages of litigation, including pre-trial, "trial" specifically refers to the period for the introduction of evidence by both parties. The presentation of evidence during the trial follows a scheduled order and must be continuous within prescribed periods. Depositions taken before trial may also be used at the trial or upon hearing of a motion.
