Definition of Innominate Contract
An innominate contract does not have its own individuality and is not distinguished by a particular or special name in the Civil Code. Innominate contracts are governed by the stipulations of the parties, the provisions of Titles I and II of Book IV of the Civil Code, the rules governing the most analogous nominate contracts, and the customs of the place.
Kinds of Innominate Contracts
- Do ut des (I give that you may give).
- Do ut facias (I give that you may do).
- Facio ut des (I do that you may give).
- Facio ut facias (I do that you may do).
