Definition of Gratuitous or Lucrative Contract
A gratuitous contract, also known as a contract of pure beneficence, is one where the cause is the mere liberality of the benefactor.
Characteristic Related to Cause
In gratuitous contracts, the liberality of the donor is considered the cause. This distinguishes them from onerous contracts, where the cause is the prestation or promise of a thing or service by the other party, and remuneratory contracts, where the cause is the service or benefit remunerated.
