Definition

Formal or solemn contracts are those where special formalities are essential for perfection or validity.

Requirement for Validity

In this classification of contracts, the contract is perfected only when specific legal formalities are observed. The validity of the contract is contingent upon the fulfillment of these required forms.

Example

A simple donation inter vivos is an example of a formal or solemn contract. For such a donation to be valid and perfected, it must be in a public instrument, as required by law (Art. 749, Civil Code). Failure to follow the formal requisites for donations can result in the donation being void.
