Definition of Entry of Judgment

Entry of judgment is the physical act performed by the clerk of court in entering the dispositive portion of a judgment or final order in the book of entries of judgments. This act serves as the formal recording of the court's decision.

Process of Entry

The process involves the clerk of court recording the dispositive part of the judgment or final order. The record should contain the dispositive portion, signed by the clerk, along with a certificate stating that the judgment or final order has become final and executory. This certification confirms the judgment's executory nature.

Significance and Date of Entry

The date of finality and the date of entry of a judgment are distinct. Entry of judgment presupposes that a judgment has become final. Finality occurs when no appeal is taken within the reglementary period. According to the 1997 Rules of Court, the date of entry is the date when the judgment becomes final and executory, regardless of the actual date the physical act of entry was performed. This rule aimed to prevent confusion regarding the reckoning date.
