Definition of Cyberlibel
Cyberlibel refers to the unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, but committed through a computer system or any other similar means.
Statutory Basis
Cyberlibel is defined under the Cybercrime Prevention Act of 2012 (R.A. No. 10175). Specifically, it involves online defamation and is referenced under Section 4(c)(4) of R.A. No. 10175, in relation to Article 355 of the Revised Penal Code.
Relationship to Traditional Libel
Cyberlibel is considered a new crime. The elements of cyberlibel are the same as the elements of traditional libel under the Revised Penal Code. The primary difference between cyberlibel and traditional libel is the use of a computer system in committing the offense.
