Alias Summons
A

An alias summons is a writ issued by the clerk of court. It is typically issued upon motion. An alias summons may be issued when the original summons is lost, destroyed, or returned without being served on all defendants. When issued, it supersedes the first summons.

A motion for the issuance of an alias summons is classified as a non-litigious motion. Non-litigious motions are those which the court may act upon without prejudicing the rights of adverse parties. These motions shall not be set for hearing and shall be resolved by the court within five calendar days from receipt.
