Absolutory Cause
A
Absolutory causes are circumstances where an act committed is a crime, but for reasons of public policy and sentiment, no penalty is imposed. Justifying and exempting circumstances are absolutory causes.
Examples
- Spontaneous desistance before all acts of execution are performed.
- Inflicting less serious or slight physical injuries under exceptional circumstances outlined in Article 247.
- Attempted or frustrated light felonies.
- Instigation.
- Marriage between the offender and the offended party in certain crimes such as seduction, abduction, acts of lasciviousness, and rape.
- Accessories who are exempt from criminal liability due to their relationship with the principal offender, with certain exceptions.
